Who can be Witnesses under my Will?

Witnesses can be anyone 18 years of age or older with full mental capacity and should not be married or be in a de facto relationship with you.

Importantly, a witness should not be an executor nor a Guardian under your Will. A witness should not also be a beneficiary, a spouse nor a domestic partner of a beneficiary under your Will or they may lose their entitlement under your Will.

Using the same pen, your witnesses will need to complete their section under your Will and sign in your presence and each other’s presence.

Use the Same Pen

For your Will to be legally valid, you must sign your Will using the same pen before two witnesses at the same time.

After signing and witnessing is complete, you will have completed your Will.
