Under your Will the executor and trustee will be the same person.

As a Will-maker you can appoint one or two persons to be your executor and trustee.

The executor can be any person who is 18 years of age or older. They must not be bankrupt and not be prevented from acting because of a disability.

You can also appoint one alternate executor and trustee, which is optional.

It is important that you only appoint persons you strongly believe will be able to cooperate with one another when carrying out the terms of your Will.

If you wish, a beneficiary can also be an executor and trustee under your Will.

What is the role of an Executor and Trustee?

The role of an executor is to manage your estate following your death. They are responsible for paying out all debts from your estate.

Whereas the role of a trustee is to oversee the ongoing administration of your estate and the beneficial entitlements you leave behind for any beneficiaries under your Will.
